By accessing or using the services provided by The MCP Company ("we," "our," or "us"), including the mcp-tap platform, website, and any related APIs (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

2. Description of Services

The MCP Company provides MCP observability and security infrastructure. Our mcp-tap product enables developers to monitor, debug, and secure AI agent tool calls made through the Model Context Protocol (MCP). Services may include telemetry collection, session replay, latency tracking, anomaly detection, and related analytics.

3. Account Registration

You may need to create an account to access certain features of our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

4. Acceptable Use

You agree not to use the Services for any unlawful purpose; to attempt to gain unauthorized access to our systems or other users' accounts; to interfere with or disrupt the integrity or performance of the Services; to reverse-engineer, decompile, or disassemble any part of the Services; or to transmit any malicious code, viruses, or harmful data through the Services.

5. Intellectual Property

All intellectual property rights in the Services, including software, documentation, trademarks, and trade secrets, are owned by The MCP Company. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. Your data remains yours -- we claim no ownership over the telemetry data you process through mcp-tap.

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of your information as described therein. You are responsible for ensuring that your use of our Services complies with all applicable data protection laws.

7. Limitation of Liability

To the maximum extent permitted by law, The MCP Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure. During our beta and waitlist phases, features may change without notice.

9. Termination

We may suspend or terminate your access to the Services at any time for any reason, including breach of these Terms. Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination will continue to apply.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
